Material allergies and assumption of risk

Some shoes / boots contain leather and / or metal parts. lateXperiment does not warrant that any of its products are free of leather and specific metal. If you know or suspect that you or anyone who may come in contact with any products purchased on the lateXperiment website has had or may have an allergic reaction to leather or metal, you agree to contact the manufacturer prior to use to be sure the product is leather or metal free. People at risk for leather allergies include, but is not limited to, those individuals with spina bifida and congenital genitourinary abnormalities, health care workers (housekeepers, lab workers, dentists, nurses, physicians), rubber industry workers, atopic patients (asthma, rhinitis, eczema), and patients who have undergone multiple procedures. The leather allergy risk group may also include people with allergic reactions to banana, avocado, chestnut, apricot, kiwi, papaya, passion fruit, pineapple, peach, nectarine, plum, cherry, melon, fig, grape, potato, tomato and celery. Order Delivery
We process and ship all orders as quickly as possible. If an order is returned to us as "undeliverable" we will attempt to contact the customer to obtain the information necessary to redeliver the order. If an order that is returned to us is ultimately not deliverable we will refund the customer's credit card, PayPal account and cancel the order. You agree to indemnify and hold lateXperiment harmless from any claims, losses, or damages resulting from not receiving an order when the carrier (either UPS, USPS or FedEx) has confirmed delivery of the order.

While the lateXperiment website contains links to third-party sites, you agree that lateXperiment is not responsible for the content or the consequences of viewing any linked sites. lateXperiment provides these links as a convenience and does not endorse the companies or contents of any linked sites.

Jurisdiction and choice of law
Your use of this website, and it's Terms of Use and the Privacy Policy shall be construed and controlled by the laws of the State of New Jersey. Further, any dispute arising from your use of this web site, or its Terms of Use or Privacy Policy, shall be governed by the laws of the State of New Jersey. By accessing this web site, you agree to personal jurisdiction by the State and Federal courts sitting in the State of New Jersey, County of Morristown.

Shipping if applicable

UPS Ground
Orders shipped via UPS Ground typically arrive within 5 to 7 days from the date the order is shipped. UPS Ground is not available for PO Boxes, APO''s or FPO''s, Alaska or Hawaii.

USPS Priority Mail
Orders shipped via USPS Priority Mail typically arrive within 2 to 5 days from the date the order is shipped. Delivery to APO''s and FPO''s can take up to ten days, and shipments to Alaska, Hawaii and other non-continental US territories can take a few days longer.

FedEx Ground
Orders shipped via FedEx Ground typically arrive within 2 to 5 days from the date the order is shipped. FedEx Ground does not deliver to PO Boxes, APO''s, FPO''s or other military addresses, or any overseas addresses. FedEx Ground is available in Canada.

FedEx Two Business Day
Orders shipped via FedEx Two Business Day Service will arrive within 2 business days of shipment. Please be aware that Saturdays, Sundays and holidays are not considered business days. It is also important to note that this service is not available if your order is being shipped to a PO box, APO, FPO or other Military address, or any address outside the Continental US.

FedEx Next Business Day Orders shipped via FedEx:
Next Business Day Service will arrive the business day following the day your order is shipped. Please be aware that Saturdays, Sundays and holidays are not considered business days. It is also important to note that this service is not available if your order is being shipped to a PO box, APO, FPO or other Military address, or any address outside the Continental US.

International Shipping Options
Our international shipping prices are based on our actual shipping costs. All shipping information is available for your review before finalizing your order.
APO's & FPO's All packages to APO's and FPO's are shipped via USPS Priority Mail, and the cost is about the same as it is to ship a package within the United States. FedEx and UPS does not eliver to APO's or FPO's.

Shipping to Canada Shipping to Canada costs slightly more than shipping within the US but significantly less than shipping to most other countries. Prices average around $35 (CAD).

Limitation of Liability
Each product we sell is legal in the United States. However, foreign governments and customs authorities often have different ideas of what is legal to import. Certain countries do not allow the importation of adult toys / shoes. We cannot accept responsibility for any items that are confiscated, seized or otherwise diverted by foreign governments, foreign customs authorities or other foreign agencies. All tariffs, taxes and import duties are the sole responsibility of the customer.

Price Adjustments
International shipping prices fluctuate from time to time and occasionally our cost to ship an order internationally is higher than what was quoted to the customer during the checkout process. If the cost to ship your order is higher than the shipping price quoted during the checkout process we will contact you prior to shipping your order. You can choose to continue your order, change the shipping address for your order, or cancel your order. If you choose to continue with your order your grand total will be recalculated with the updated shipping charges.

Shipping and Billing Address
Please note that the shipping and billing address must be the same for international orders. We will not accept, for example, an order shipped internationally that is billed to a US mailing address. The only exception is for shipments to APO's.

Shipping Prices
Our shipping prices are based on weight caculation. If you would like to calculate what an order would cost to ship you may use the following information.

Discreet Packaging and Shipping
We recognize that most of our customers want to maintain their privacy when ordering adult toys / shoes. For that reason all orders are shipped discreetly in either plain brown or white boxes. The lateXperiment logo is not present anywhere on our packaging or on the return label, nor is any description of the package contents. The return address will say "7Ways", which is the name of our shipping address.

Order Status
You can check the status of your order just per email. All you need is your Name and Date. Orders need to be processed and the system updated. If there is a problem with your order we will contact you via email. If you have a question about your order please contact us at maildesk(AT)latexperiment.com.

Order Tracking
After we ship your order we''ll send you a shipping confirmation email. This email will include your package tracking information which you can use to track the progress of your shipment. The web addresses for our carriers are: www.fedex.com, www.ups.com, and www.usps.com.

Order Processing
We ship most orders within 2-4 days (excluding weekends). Some orders take 4-8 days to process. Orders can take longer depending on the time of day they're placed, the day of the week they're placed, or other factors. For example, an order placed at midnight on Friday will not be shipped until at least Monday.

Product Availability
We ship orders as quickly as possible. On occasion an item will go out of stock, in which case that item is backordered. It takes just a week to receive backordered items from the manufacturer. If there is a delay at the manufacturer for an item it can take longer, but this is uncommon.

Out of Stock / Backordered
If your order status is "Backordered" you have several options. The first option is to wait for us to restock the item, which usually only takes one to seven business days. If you don''t want to wait you have the option of substituting another item(s) for the one that is out of stock. If you want to make a substitution just send us an email and let us know. The third option is to cancel your order.

Returned Orders
If you order is returned to us as undeliverable we will contact you via email. You can opt to have your order reshipped or canceled. If you choose to reship your order your credit card / PayPal account will be charged for the extra shipping fee. If you choose to cancel your order we will refund your order total, minus shipping and a 30% restocking fee.

Refunds
If you have once entered the members area you can't earn a refund! The log files show it if you entered the members area. There is no discussion about it.
